Below you will find TPD's terms of service and privacy policy

We're providing a comprehensive amount of information to ensure you're fully informed about our services and your interactions with us. At TPD, transparency is key—we aim for you to understand, without any doubts, how our processes work and what your engagement with us entails. We strongly encourage you to read through these terms and any sections that particularly interest you, as by proceeding with your application, you agree to these Terms of Service (the “Agreement”) then in effect with the following entity or entities:

Any references to “TPD” or “we” in this Agreement shall mean the applicable entity as set forth above.

Terms and Conditions for Job Applicants

In submitting an application or otherwise utilizing TPD’s services, you agree that you will not: 

  1. Impersonate any person or entity, or otherwise misrepresent your affiliation with a person or entity
  2. Provide any incomplete, false, or inaccurate information regarding your credentials or work experience
  3. Use the Service to solicit for any other business or service, or contact TPD’s clients directly for employment (or any other purpose) not related to the use of TPD’s service

By providing and submitting your personal information to TPD in the form of an application, resume, or contact form,  the applicant grants permission for TPD to:

  • Send electronic communication regarding future opportunities and career resources. The applicant may unsubscribe at any time by mail at 1055 W Georgia St., Suite 2400, Vancouver, BC V6E 3P3  by phone at 1.888.685.3530, or by email at info@tpd.com.
  • Disclose the applicant's resume (unidentifiable or as written) to our clients and associates to assess suitability for current and future job opportunities and establish an employment or independent contractor relationship.
  • Contact the applicant's former employers with consent in the form of employment references, and for those former employers to furnish their records of the applicant's service, together with any other information they may have regarding performance whether on record or not. The applicant hereby releases them and TPD from all liabilities for any damages for issuing the same.

Please note that TPD does not control the interview questions and job qualification criteria of our clients as direct employers. Our clients are solely responsible for compliance with all applicable laws, including the Fair Credit Reporting Act and similar laws, anti-discrimination laws such as Title VII of the Civil Rights Act of 1964, as amended, the Age Discrimination in Employment Act, the Americans with Disabilities Act, and any applicable data protection or privacy laws. Our clients are responsible for offering alternative methods of screening, if so required by the Americans with Disabilities Act or any similar law. 

For direct hire jobs, TPD is responsible for connecting the job seeker and employer, and does not guarantee the identity of any employer or any individuals working for any Employers, the health and safety measures in an Employer’s environment, or the accuracy or validity of a job offer. TPD cautions Job Seekers to verify the accuracy and validity of a job offer before taking an adverse action regarding their current employment situation. 

Fee Prohibition

Section 12 of the Employment Agency Business Licensing Regulation prohibits an employment agency business operator from directly or indirectly demanding or collecting a fee, reward or other compensation

  1. from an individual who is seeking employment or from another person on that individual’s behalf,
  2. from an individual who is seeking information respecting employers seeking employees or from another person on that individual’s behalf,
  3. from an individual for securing or attempting to secure employment for the individual or providing the individual with information respecting any employer seeking employees or from another person on that individual’s behalf, or
  4. from an individual for evaluating or testing the individual, or arranging for the individual to be evaluated or tested, for skills or knowledge required for employment, where the individual or employment is in Alberta, or from another person on that individual’s behalf.

No professional advice 

As part of our services, TPD may provide suggestions regarding training, education, and career strategies. These recommendations are intended for informational purposes only and should not be considered as legal or professional advice. TPD cannot ensure the accuracy or current relevance of the information or advice given. TPD will not be responsible for any losses incurred due to decisions or actions taken based on the information provided by our services.

Limitation of Liability

TPD and its affiliates shall not, under any circumstances, be liable for any direct, indirect, special, incidental, consequential, or punitive damages, whether in contract, tort, or any other theory of law, related to or arising from your use of our services, your engagement with potential employers, or any actions taken based on the information provided through our services. This limitation applies even if TPD has been advised of the possibility of such damages.

Indemnity

You agree to indemnify and hold harmless TPD, its group companies, and their respective officers, directors, agents, and employees from any claims, demands, including legal fees and costs, made against us by any third party due to or arising out of your negligence, misrepresentation, breach of terms, or infringement of any laws or rights in the course of your engagement with our services or with potential employers through our services.

Your Privacy is Important to Us

Protecting the privacy and confidentiality of personal information has always been a fundamental principle in our business relationships. We want you to know that TPD adheres to privacy legislation that governs what information may be collected, how it is used and how it is protected. This Privacy Statement explains our privacy policies and information handling practices.

Protecting your privacy means:

  • We keep your personal information and the business you do with us in strict confidence
  • We do not sell your personal information
  • You have the ability to control how we use and give out personal information about you
  • You have reasonable access to the personal information we have about you
  • We respect your privacy when we market our services

Why we collect personal information

We collect information in order to represent you for direct hire and contract employment opportunities with our clients, to carry out contests or surveys, to administer our website, and to provide information about our services. We understand that some of this information is personal. We collect, use and disclose personal information only for purposes that a reasonable person would consider appropriate in the circumstances. The information we will collect from you includes but is not limited to:

  • Your personal profile via your resume and information supplied by you
  • Your employment preferences, such as work location, salary, and other personal factors important to you

You can visit our website without sharing any personal information. While visiting our site, you may choose to provide information in the form of a resume or by completing a contact form.  In order to be considered for opportunities with our clients, you may choose to provide references. While using our website, you may choose to provide personal information in order to enter a contest or complete a survey.

You may voluntarily provide TPD with certain demographic information about yourself, such as your race and ethnicity, gender, age, LGBTQ+ community membership, and disability status (“Demographic Information”). By choosing to provide your Demographic Information, you agree that TPD may use it to evaluate and improve our service and share aggregate summaries of job seeker information with employers. If you do not want your Demographic Information to be used in this way, do not provide it to TPD (or, if you have already provided your Demographic Information to TPD, you can request it be removed). 

Please note that TPD is required to comply with legal obligations or governmental requests and may exercise its legal rights or defend against legal claims and that such process from courts or law enforcement may require disclosure of user data, including demographic data.

What we do with personal information

When you provide personal information to us in the form of a resume, by completing a contact form, by participating in a contest or survey, or through a third-party such as Indeed, ZipRecruiter, Linkedin, other job boards, or other parties, the information will be stored in our secure database. We may use your personal information to:

  • Match your profile against our client's requirements
  • Contact you regarding profile matches
  • Contact and obtain information about you from references supplied by you (upon your approval, see Your Information is Obtained or Used Only With Your Consent)
  • Provide your information to clients (upon your approval, see Your Information is Obtained or Used Only With Your Consent)
  • Carry out contests and/or surveys
  • Improve our site and, where applicable, the services we offer
  • We may send you information about our company and promotional material from some of our partners from time to time. If you would like to opt-out from receiving this information, you may do so either by using the “Opt-Out” statement at the bottom of the correspondence, or by responding “Stop”. If you have further concerns about receiving occasional communication from us, please contact our Privacy Officer at info@tpd.com or by phone at 1-888-685-3530.
  • Demographic data collected while visiting our site is used to tailor your experience at our site and to display content that we think you might be interested in. We also use this data to learn more about the demographics of our site visitors and to refine our marketing plans.
  • For other similar or related purposes that are reasonably necessary for the proper management of TPD’s business.

TPD Communication and Collection of Information After Placement

When you are placed on assignment with one of our clients, we will collect additional information in order to complete the placement process. In addition, we will survey you to ensure that we are offering our candidates the best possible opportunities and to provide our clients with constructive feedback. We will survey clients to verify and confirm the information we currently have in your file and to ensure our candidates are consistently meeting client expectations.

Your information is obtained and used only with your consent

We want to assure you that any personal information you provide to TPD will remain completely confidential until you request otherwise, unless required by law. We do not sell or provide candidate or client information to third parties. We will always obtain your authorization to contact references and we will always contact you via email or telephone before we submit your profile to a client requirement.

Your consent can be express or implied

Express consent can be verbal or written. You imply consent when we reasonably conclude that you have given consent by some action you have taken, or when you decide not to take action. For example, by providing your contact information, profile or other personal information to a recruitment specialist or through our website, you are granting your consent to allow TPD to use your profile information in the matching process and to contact you regarding any such matches.

You can withdraw your consent after you’ve given it

While we would like your consent to continue to collect and use your information as outlined above, we want you to know that you do have choices.  In addition, you can request to have your information removed from our database or opt out of receiving optional future mailings at any time by contacting our Privacy Officer at info@tpd.com or by phone at 1-888-685-3530.

We protect your information from error, loss, and unauthorized access

Our employees who have access to your information are made aware of how to keep it confidential. Each employee is governed by policies regarding information handling. Only employees who require access to your information in the course of their duties will have access to your information.

We respect the confidential information that we receive from others and therefore will not release any personal information provided to us by third parties without their explicit authorization.

As a member of the TPD online community, you have access to your own information, information about positions that match your profile, plus additional information and tools. Select TPD personnel have password-protected access to your information. Authorized client/employer contacts are able to view candidate information without seeing your identity. No client/employer contact may view your personal information (identity or contact information) without your prior permission.

You can see and verify the accuracy of your information

You can update your personal information at any time through our website or by contacting our Privacy Officer.

If you would like access to the personal information we have on file for you, we will ask you to put your request in writing to our Privacy Officer by email at info@tpd.com or by mail at 1055 W Georgia St., Suite 2400

Vancouver, BC V6E 3P3. You will be given reasonable access to your personal information to verify or correct information. Every effort will be made to respond to your inquiry within 30 days. There may be circumstances where TPD will not provide you with access or may require additional time to meet your request, in which case you will be informed.

Our site may contain links to other sites that we think you might be interested in. While we try to link only to sites that share our high standards and respect for privacy, we are not responsible for the content, security, or privacy practices employed by other sites.

Cookies

Our site uses cookies to keep track of user sessions. Cookies improve functionality and in some cases, provide visitors with a customized online experience.

Password protection

Portions of our website are password-protected to help safeguard your information. When you complete your registration, you will create a password to access portions of the site. TPD reserves the right to change passwords at any time to protect the security of our site. We require that you keep confidential the password you select for accessing our site. We require that you email us immediately at info@tpd.com if you feel that your password has been compromised. If you forget your password, email us and we will issue a reminder of your password via email.

Resolving your concerns and inquiries, or listening to your suggestions is important to us

In order to continually monitor and strengthen our privacy procedures, we have appointed a Privacy Officer who can be contacted through our head office at 1.888.685.3530. Please contact our Privacy Officer if you have any questions about privacy that were not answered above. We welcome your suggestions.

Changes to this privacy statement

TPD reserves the right to modify or supplement our terms of service and privacy statement at any time, by notifying you of such changes by any reasonable means, including by posting the latest version on the site with the date it was last updated. By using the Service after any changes have been posted, you agree to the new terms.
